Alberta employment agencies thrive as job losses grow

Critics call for stricter regulation, tougher enforcement for rapidly expanding industry

The number of licensed employment agencies in Alberta has skyrocketed 279 per cent in less than three years, spurring a government review and calls from some observers for stricter regulations and stronger enforcement.

The surge in employment agencies has chiefly surfaced over the last two years. In 2007, there were 184 licensed employment agencies, swelling to 480 in 2008.The provincial count now stands at 698.

The province points to a shortage of skilled labourers during the economic boom as the main reason behind the growth in companies connecting workers with employers for permanent jobs. Also, some smaller agencies didn't realize they needed a provincial licence to operate, said Cam Traynor, a spokesman for Service Alberta.

The onset of recession hasn't yet stymied the industry's expansion. While the pool of employers looking to hire has diminished, more and more workers are turning to employment agencies for help finding a job, several agencies report.

The sector's rapid growth has caught the attention of Service Alberta Minister Heather Klimchuk, whose department is working with Employment and Immigration to examine whether regulatory changes are needed.

"We want to make sure that the individuals who are in this business know what they should be doing and should not be doing," Klimchuk said recently, adding she also wants to ensure "people looking for work in Alberta are treated fairly."

As employment agencies have multiplied, so have the number of complaints and government investigations.

Currently, the province is investigating 285 complaints against agencies, most of them centring on fees charged to temporary foreign workers. It's illegal under the provincial Fair Trading Act to require a worker to pay for finding a job. Agencies make their money on recruitment fees paid by employers.

If an employment agency is convicted of breaking the provincial rule, the company's owner could face a fine as high as $100,000 or a jail sentence of up to two years, or a combination of both.
However, in the past five years, only one agency owner has been convicted of violating the law.
Calgarian Rosalie Marie Maronese, who started up That Recruiting Company, was fined$3,000 in 2006 for misleading consumers and for pocketing $11,328 in fees from 18 temporary foreign workers. She was ordered to pay the money back to her victims.

Two other cases are before the courts. Josephine Garcia Ramoso of Edmonton, a foreign employment recruiter, faces charges of fraud and unfair business practices. She's accused of illegally collecting $15,000 in fees from nine Filipino workers, who were never offered jobs in Alberta.

In March, Calgarian Michael James Delorme is scheduled to appear in court to face charges of unfair business practices and illegally charging a $500 fee to a non-temporary foreign worker. Delorme's employment agency licence has been cancelled.

Not all employment agencies cater to temporary foreign workers. Specialties can vary, from headhunting executives for the energy sector to recruiting workers to fill office towers and construction sites.

But Calgary immigration lawyer Michael Greene believes Alberta's explosion in employment agencies is mainly tied to an influx of temporary foreign workers--57,843 in 2008 and 37,293 in 2007.

"It's a bit like the Klondike," he said. "A lot of people smelled money and came running, and that's led to a lot of abuses. There's a lot of people doing this kind of work who really don't know what they're doing."

Greene thinks stricter regulations, stronger enforcement and stiffer penalties are needed. He said temporary foreign workers are particularly vulnerable because they don't always know provincial rules and often are afraid to speak out.

Liberal MLA Hugh MacDonald, the party's employment and immigration critic, shares Greene's concerns about the treatment of foreign workers by some employment agencies.

He wants the Alberta government to mandate that companies only use recruiting firms backed by foreign governments. He also thinks the province should expand its regulation of employment agencies to include companies that find workers temporary jobs.

Alberta, British Columbia and Manitoba are the only provinces that regulate employment agencies, said Mary McIninch, manager of government relations for the Association of Canadian Search Employment and Staffing Services.

Ontario is considering following suit, but she added no province regulates firms that recruit workers for temporary placements.

Russ McLean thinks some government rules are needed to oversee companies recruiting workers for temporary jobs. The 48-year-old Calgarian has routinely relied on agencies for temporary work, taking on painting, roofing and landscaping jobs, to name a few.

He said some agencies charge so many fees, including requiring money for transportation and safety equipment, there's little money left for workers at the end of a shift.

"I have a bit of an update about Rosie (as I knew her) albiet several month ago now.

She scammed me by not delivering business services that she was paid for. She also stole a company laptop computer. I first me her in Apr 2008 in Toronto. She bean "working" for me between May and July at which time she claimed to be driving between Toronto and Calgary all the time for her sales job - selling jewelry for a company.

She is very evasive and I am interested in justice being found before she strikes again!"

Police search for former day home owner

Calgary police are looking for a woman who ran a day home in Southwest Calgary.

CTV first learned about Rosalie Maronese this past summer when angry parents and former day home employees said Maronese didn’t pay them what they were owed.

There weren’t any criminal charged in that case, but now police want her for something else.

Calgary police have an arrest warrant for a separate incident.

Officers tells CTV that she responded to two ads placed by Calgarians, each seeking a pair of season tickets to the Calgary Flames.

Police say she took 8000 dollars from one, $4000 from the other and sent them to the Saddledome to pick up their tickets.

However, when the unsuspecting victims went to claim their tickets they were told the tickets didn’t exist and that Maronese did not own any season passes.

Now, she is wanted for two counts of fraud.

In January, an employment agency operated by Maronese called “That Recruitment Company” pleaded guilty to operating without a license and direct selling without a licence.

Police believe Maronese has left her home in Cougar Ridge where angry parents and ex-dayhome employees picketed this summer to recover money they said she owed them.

Gord Southam gave Maronese a $3600 deposit to hold two spots for his kids in a daycare she never in fact owned.

He says he sued her and won in small claims court, but never collected.

And though it’s not for her daycare dealings, Southam says he’s glad the police are planning to charge Maronese with something.

Rosalie has taken vast amounts of money from local businesses and not lived up to her contractual commitments, as well as not paying folks she took services from. She is a scam artist who has left a trail of fraud across Canada.(Do a Goggle search!) It would be unwise to do any type of business with her.

We found out and confirmed today that Rosalie's cell number has been "temporarily disconnected".

This is a similiar pattern to her activities the last couple of years. You play phone tag she makes promises and then simply disappears until months later when you track her down again. Let's all get organized and stop this woman!

She came here with this idea of a company called girls night out tours. The idea is great I think but it's who runs it that is the problem. She organizes a group of ladies to get picked up by a limo and it takes them out on a night on the town. There are several stops along the way with different vendors. After running these tours for 3 weeks, we soon realized who we were dealing with when the vendors were complaining about not getting paid. Myself included, acted as host to these tours and learned first hand what a scam artist she was by lying to me and others involved in this company. She has gone on to write several rubber cheques and makes it sound like it is the banks fault. I hated playing phone tag with her trying to get my money. And on top of that, she was looking for ads for this ad book called "The Little Redbook" which she said would be given to every lady who went on a tour plus run in the city newspaper in January. I even helped get her 2 ads from friends of mine. The London Police have a file number I found out based on this scam. Apparently there are other businesses who have paid for an ad and seen nothing. i came across this blog from someone close to Rose and immediately felt sick to my stomach. I can't believe that after reading all that she has done in her past that she continues to scam people. From the beginning she always said that her ex boyfriend was the cause for her problems and that he tried to ruion her in Calagary and he is making her look bad. She is such a liar and i have drawn together a group in London that have been "touched" by her to file a case in small claims court to get our money back. She messed with the wrong people. Many of those who are victims of Rosalie Maronese are inquiring as to restitution and how to obtain. Our best answer is for all of us to keep the investigation going. We understand that some of the cases against Rosalie were closed in October. If you are being represented by the investigator (Trevor Schulz) of Alberta Government Services (AGS) and your claim is still ongoing then there is hope.

The only reason that restitution was paid to the victims in the ticket fraud was that Rosalie was seeking to avoid jail time or any type of criminal sentence whatsoever. It is understandable that the victims of that case settled for money.

If those of you who are still seeking answers, and you have AGS working on your behalf you can contact them anytime to obtain an update. It is your right as a victim and consumer. Trevor's contact information is contained in the links on the right side of the blog "Email AGS".

There appears to be seperate issues circulating in the London Ontario region. AGS is not responsible for any actions in Ontario.

Rosalie Maronese was in Alberta Provincial Criminal Court today. Contrary to rumors the charges against her hadn't been dropped.

It may come as a disappointment to some but Rosalie plea bargained her way out of a conviction today. Rosalie Maronese has been ordered by the Alberta Provincial Court to make restitution to

her victims in regards to the charges that had been laid against her.

Tomorrow, Rosalie or her lawyer will appear in Court Room 306 to pay restitution. The time of this matter is at 9am Calgary time.

Many of you are inquiring for an update on what is happening with Rosalie Maronese. There are two significant developments that are underway presently.

We can report that Rosalie has been charged with two counts of fraud and will be facing trial this December. These charges stem from a ticket scam that Rosalie was perpetuating on victims in and around the Calgary area. The charges are related to Maronese offering tickets to Calgary Flames games for buyers and not providing the tickets. CTV covered the story in the Calgary area and you can read it by clicking on this link.
Alberta Government Services is conducting an investigation into Rosalie Maronese in regards to her nanny services and dayhome activities. As many of you know victims provided Maronese with deposits for services and never received (in some cases) service or refunds when they cancelled their contracts with Rosalie. Those that have not filed a complaint with Alberta Government Services may not be represented by the department in their investigation at this time.

Rosalie appears to have left the Calgary area in late 2006 or early 2007. We believe her to be in Ontario but expect that she will have to return in December to face the charges brought against her by the Calgary Police Service.

this very bad lady also victimized my younger sister! I don't know how was she asble to get our numbers home phone and cell number! She called up and recruited my sister who just graduated and passed the PT board exam here in philippines! She told my sister that she will be needing 2 physical therapist. She insisted that we would give her 1500 dollars right away so that her application would be faster! We gave her the said amount through WESTERN UNION! After that we seldom hear anything from her! The worst thing was she never called! and we came to a point that we were the ones calling her to calgary Canada just to follow-up my sister's application! WE HOPE WE CAN GET OUR MONEY BACK!!! An Alberta home contractor has been sent to jail for 90 days after taking money in advance for jobs he never completed.

Max Samoila of Medicine Hat pleaded guilty in provincial court Thursday under Alberta's Fair Trading Act to failing to refund homeowners' money within 15 days of the cancellation date of contracts.

Announcing the conviction Monday, provincial officials said homeowners should resist booking the first person available to do the job in a buoyant economy where tradespeople are often overbooked.

"Most reputable contractors have charge accounts with their suppliers and don't require money up front," said Eoin Kenny, spokesman for Service Alberta.

"If a contractor does ask for money up front, you should then ask to see his prepaid contractor's licence. That's a provincial licence that requires a contractor to be licensed and to have a security in place – some form of guarantee."

Kenny adds that people should check a contractor's references before signing a contract, which should outline start and completion dates.

Samoila, who is not licensed by the province or bonded as a prepaid contractor, has to pay restitution of $99,900 to the homeowners and will be on probation for 33 months after completing his 90-day sentence.

In one case, a couple contracted him to build a home for $130,000.

After they gave Samoila more than $100,000, he told the couple he couldn't do any more work on the home. The couple paid an extra $98,000 to have someone else complete the job, plus they had to pay $10,000 to remove a lien on their home after Samoila didn't pay a supplier.

In two other cases, Samoila refused to refund deposits of about $14,000 and $2,500 to his clients.

Information that would be useful for meeting

One of the avenues that we are pursuing is the tax evasion angle.

We are going to pursue the CRA angle and put together a package for the CRA tax investigations unit. In order to shed more light on this issue and make a stronger case, we could really use the help of the other victims.  A statement outlining the amount given to Rosalie, when , at what location and for what services. Also, proof of receipt, cashed cheques, invoices would also help. We suspect some people have done this already and submitted it to the police (we should hope so anyway). With respect to her recruiting company business, a statement from the employees or victims of that fraud would also help.

Other useful information that CRA is looking for is net worth information, such as assets, liabilities, personal expenditures, etc.

Also, we would appreciate the GST information. Rosalie Maronese does have a registered GST account, but we're not sure if she ever claimed for GST.  Anyway, this is also useful info we would like to include in our brief to CRA.

Any documentation you can all bring to the upcoming meeting is appreciated. Let us all keep working to put a stop to her ways.

If you've supplied Rosalie with personal information, I encourage you to contact the Office of the Information and Privacy Commissioner. The contact numbers are provided in the blog links or achives. It may not get you your money back, but it will make other agencies aware of Rosalie Maronese's schemes. The more complaints, the better.

Rosalie Maronese is back in town

I was at Rosalie's house this evening ( Sat. Oct. 28/06)....of course she would not answer the door. She arrived back in town yesterday, was doing some " major house cleaning" today, and now has new roomates.
I am another victom of her fraudulent ways, and INTEND on getting my money back from her !!!
I spoke with her neighbours, and it seems that there are MANY of us who are trying to get money back from Rosalie.......I think we all need to work together on this ! What are your thoughts??
