Rosalie Maronese Tax Time

So with tax time around the corner how should we all deal with the money that we gave Rosalie for services? We think you should claim them!!

This may prompt an audit by CRA given the fact that she is taking deposits and in many cases not providing receipts or refunds.

Trial Date put over again and again....


Rosalie's trial date has been put over again. Her lawyer appeared for her this morning and stated something about disclosure. Two new dates have been put forward we will confirm them when they are made available.


March 1st, 2007 and March 14th, 2007. (to be confirmed)


What we do know at this time is that Rosalie is in Ontario and AGS is still investigating.

Alberta Fair Trading Act Convictions

An unrelated story but it does show what the government is doing to those convicted under the fair trading act in Alberta.

An Alberta home contractor has been sent to jail for 90 days after taking money in advance for jobs he never completed.

Max Samoila of Medicine Hat pleaded guilty in provincial court Thursday under Alberta's Fair Trading Act to failing to refund homeowners' money within 15 days of the cancellation date of contracts.

Announcing the conviction Monday, provincial officials said homeowners should resist booking the first person available to do the job in a buoyant economy where tradespeople are often overbooked.

"Most reputable contractors have charge accounts with their suppliers and don't require money up front," said Eoin Kenny, spokesman for Service Alberta.

"If a contractor does ask for money up front, you should then ask to see his prepaid contractor's licence. That's a provincial licence that requires a contractor to be licensed and to have a security in place – some form of guarantee."

Kenny adds that people should check a contractor's references before signing a contract, which should outline start and completion dates.


Samoila, who is not licensed by the province or bonded as a prepaid contractor, has to pay restitution of $99,900 to the homeowners and will be on probation for 33 months after completing his 90-day sentence.

In one case, a couple contracted him to build a home for $130,000.

After they gave Samoila more than $100,000, he told the couple he couldn't do any more work on the home. The couple paid an extra $98,000 to have someone else complete the job, plus they had to pay $10,000 to remove a lien on their home after Samoila didn't pay a supplier.

In two other cases, Samoila refused to refund deposits of about $14,000 and $2,500 to his clients.

A date has been set for January 17, 2007 at 9:00 a.m. in court room # 102 at the Provincial Court House, Criminal Division, on 6th Ave SE (next to the public library and Bow Valley College). It doesn't mean she'll necessarily show up. She may just have representation.

Seeking information on SE Prestwick Dayhome

For any of those reading the blog. It has come to our attention that Rosalie was perpetrating the same activities in South East Calgary in the community of Prestwick. If you are a victim please respond. Your identity will be kept confidential.

We are seeking information on the location and address of this (Prestwick) property including a timeframe as to when she was supposed to be providing services. As well any NSF cheques Rosalie may have written and any documentation Rosalie may have provided. These details can be forwarded to the AGS investigator. (See link on right of page)

Meeting Discussion

The list of people chasing and suing Rosalie is growing.

A Reminder to all the parents that have made a complaint to Trevor (AGS investigator) that if
they have not provided him with all supporting documentation to do so ASAP.
We are referring to things like statements, copies of proof of payment like cheques
or money transfers to Rosalie, enrollment forms, parent packages and any
documented conversations or correspondence with Rosalie.

We are also particularly interested in any NSF cheques Rosalie has written. If
parents can please get Trevor a copy of any NSF cheques and any bank
documents in support of these cheques it would be very helpful. Trevor is
reviewing the files very closely right now and making lists of the
things that are missing. He will be contacting the
parents individually on these issues.
